1. Acceptance of Terms

By accessing or using the Evergreen Reptiles website and purchasing our animals or products, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. We reserve the right to update these terms at any time, and your continued use of the site constitutes acceptance of any changes.

2. Live Animal Sales

All animals sold by Evergreen Reptiles are captive bred and raised in our facility. By purchasing a live animal, you acknowledge and agree to the following:

  • You are legally permitted to own the species purchased in your state, county, and municipality.
  • You have appropriate housing, equipment, and knowledge to care for the animal prior to its arrival.
  • You understand that reptiles are living animals and require proper husbandry to thrive.
  • You accept responsibility for the animal's care upon confirmed delivery.
  • You are 18 years of age or older, or have parental/guardian consent.

3. Live Arrival Guarantee

We guarantee live arrival on all animals we ship. To be eligible for our live arrival guarantee:

  • You must be present to accept the package at the time of first delivery attempt, or it must be sent to a Fedex Holding Facility and is claimed within 6 hours of delivery.The guarantee is void if the package is left at the door unattended or if delivery is refused.We do not ship when weather conditions pose a risk to the animal's safety.   • You must open and inspect the package immediately upon receipt.
  • Any DOA (dead on arrival) claim must be reported to us within 2 hours of delivery with clear photographic evidence.
  • The guarantee is void if the package is left at the door unattended or if delivery is refused.
  • We do not ship when weather conditions pose a risk to the animal's safety. We reserve the right to delay shipment for the animal's welfare.

In the event of a valid DOA claim, we will offer a full refund, as long as clear photographic evidence is provided, and the animal(s) were not left unattended negligently.

4. Payments & Deposits

Payment is accepted via credit card, debit card, cash, or PayPal Goods & Services. Deposits are accepted to hold an animal and are applied toward the final purchase price. If the buyer fails to complete payment within the agreed timeframe, the deposit is forfeited and the animal may be relisted. Trades are considered on a case-by-case basis — contact us to discuss. All prices are listed in USD and are subject to change without notice.

5. Shipping Policy

We ship live animals via FedEx Priority Overnight to ensure the shortest possible transit time. Shipping costs are the responsibility of the buyer and will be calculated at checkout. We ship Monday through Wednesday to avoid animals sitting in a FedEx facility over the weekend. We reserve the right to delay shipment if weather conditions at the origin, destination, or any transit point pose a risk to the animal. In such cases, we will communicate with you promptly to reschedule.

6. Returns & Refunds

Due to the nature of live animals, we do not accept returns. All sales are final once an animal has been shipped. If you have concerns about an animal's health upon arrival, please contact us immediately. We are committed to working with our customers to resolve legitimate issues and stand behind the health of every animal we sell. Refunds are only given with DOAs that have sufficient photo evidence and non-negligent behavior on your part.

7. Health Guarantee

All animals are sold as healthy and feeding at the time of sale. This guarantee does not cover illness or injury resulting from improper husbandry, incorrect temperatures, inadequate diet, or other environmental factors within the buyer's control. If something is wrong with your animal(s), contact us IMMEDIATELY for us to help you with any issues.

8. Use of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You may not use our site to transmit harmful, offensive, or misleading content. We reserve the right to refuse service to anyone for any reason at any time. Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

9. Limitation of Liability

Evergreen Reptiles shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of our animals or products, including but not limited to veterinary costs incurred after the health guarantee period, or losses resulting from improper care. Our total liability shall not exceed the purchase price of the animal in question.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Washington State.
